Rules of Procedure

Fidelis's Rules of Procedure are designed to advance its  goals of promoting efficient and fair dispute resolution, with a strong emphasis on fostering reconciliation.

Overview of Topics Covered

Our rules address every phase of the arbitration process, including

  • Initiation Arbitration (who may file, how to begin, and what to include in your demand.)

  • Arbitrator Appointment (how arbitrators are selected, neutrally requirements, and challenge procedures.)

  • Hearing Procedures (scheduling, evidence, witness testimony, and use of technology [e.g. remote hearings])

Key Features of the Fidelis Process

  • Single Arbitrator by Default (most cases are heard by a single neutral arbitrator appointed by Fidelis.)

  • Encouragement of Reconciliation (at any point, the tribunal may invite the parties to pursue settlement or reconciliation, including a formal settlement conference.)
